Ohio’s Penalties for OVI

First OVI Offense

  • Up to 6 months in jail
  • Up to $1,000 in fines and penalties
  • 6 months to 3 years license suspension

Second OVI Offense

  • Up to 1 year in jail
  • Up to $1,500 in fines & penalties
  • 1 to 5 years license suspension

Third OVI Offense

  • Up to 1 year in jail
  • Up to $1,500 in fines & penalties
  • 1 to 10 years license suspension
  • Ignition Interlock Device (IID) required

Fourth OVI Offense

  • Up to 1 year in jail
  • Up to $10,000 in fines & penalties
  • 3 years suspension to permanent
  • Ignition Interlock Device (IID) required

Under Ohio’s implied consent law, if you refuse to submit to a chemical test in the form of a breath, blood, or urine test, you will be subject to a fine and an automatic license suspension. On a first refusal, your license will be suspended for one year, two years for a second refusal, and three years for a third refusal.
